Terms & Conditions

1. Delivery Time
Shipping occurs within two working days after the receipt of the order, provided that the goods are in stock. We reserve the right to deliver ordered quantities in parts. Performance disruptions in partial deliveries do not entitle the buyer to withdraw from the contract or claim damages. If payment conditions are not met, we are entitled to stop deliveries altogether.

2. Shipping Method and Costs
Ordered goods are shipped via postal service. Any extra costs due to express delivery are borne by the buyer. For shipments with a net goods value of less than 100.00 Euros, packaging and shipping costs will be charged. The shipment of goods is carried out at the risk and cost of the buyer or recipient. The transfer of risk occurs at the latest with the dispatch of the goods. We reserve the right to choose the shipping route and method, unless otherwise specified.

3. Reservation of Changes
FORLIFE is entitled to make an under-delivery or over-delivery of 5% of the respective order quantity. Such under and over-deliveries are due to production reasons and are considered contract-compliant by the buyer; there are explicitly no claims for defects for the mentioned quantity deviations. The amount actually delivered will be billed. There is no claim for subsequent delivery of under-delivered quantities.

4. Payments
Invoices are payable within ten days with a 2% discount or within 30 days from the invoice date without deduction. Default in payment occurs without the need for a reminder or any other procedure. In case of overdue payments, default interest of 5% above the current base interest rate plus 2.50 Euros for reminder costs will be charged. Payments from the buyer are first allocated to the costs, then to the interest, and with any surplus to the oldest invoice. Prices are quoted excluding statutory VAT.

5. Retention of Title
The delivered goods remain our property until full payment of all claims, including ancillary claims from the business relationship (for cheques until they are cashed). During the period of retention of title, the buyer is responsible for the purchased item, especially for the risk of accidental transfer or degradation of quality.

6. Warranty
We particularly point out the legal regulations according to which the buyer loses warranty claims if they do not inspect the goods immediately upon receipt and fail to report any defects immediately (§ 377 HGB). For legitimate complaints, we reserve the right to make a replacement delivery. A claim for rescission or reduction only exists after a replacement delivery has failed.

7. Regulations for Return of Goods
The return or exchange of correctly delivered goods occurs only with prior agreement. We reserve the right to dispose of unsolicited returned goods without compensation.

7.1 Defect Notification
If you receive an incorrect delivery or goods with defects from ongoing delivery, please send these goods back to us immediately, i.e., within a maximum of 14 days. Please make sure to include the original delivery note.

7.2 Credit Amount for Defect Notifications
After reviewing your defect notification, the goods will be credited to you at the purchase price. Any discounts granted will be recalculated.

7.3 Complaints
We will process and credit all goods returns immediately in accordance with these regulations with special care. Should complaints occur, e.g., due to missing credit, please raise your objection within two months from the date of dispatch. Later complaints cannot be considered as verification is no longer possible.

8. Dispute Resolution
The EU Commission has provided an Internet platform for online dispute resolution (the so-called “OS Platform”). The OS Platform serves as a contact point for the extrajudicial resolution of disputes concerning contractual obligations arising from online purchase contracts. The OS Platform can be accessed via the following link: [EU Online Dispute Resolution](https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage).

For Life Produktions- und Vertriebsgesellschaft für Heil- und Hilfsmittel mbH is neither obligated nor willing to participate in a dispute resolution process before a consumer arbitration board.

9. Jurisdiction
The place of fulfillment and jurisdiction shall be Berlin. The exclusive jurisdiction is agreed to be Berlin.
